Our business model allows us to serve legal papers for you across Canada and the U.S. We have agents throughout Ontario, across Canada and into the United States. These agents have been approved by us and we regularly use them on a daily basis. This will ensure that your legal documents are in good hands. We monitor the progress of the file and report accordingly to you. We ensure the affidavit is prepared properly so that when you are required to file the affidavit of service with the court, it will be filed successfully.

A legal officer/court official, firm or individual engaged in serving legal documents to a person in a legal matter is called a process server. A process server can perform a variety of taxes, including the filing of legal court documents, legal document retrieval and process server. Turn-around-time can vary. However, it is our practice to attempt to serve the documents at various times/days. We have different services that we offer to our customers/clients. We can do same day service (which means we will repeatedly try at the address on that day until we get the job done or conclude we cannot get it done – ie. The person is on vacation or does not reside at the address any longer). Rush service (ie. In the next two days – which means we repeatedly try the address in order to meet the deadline set by the client) and routine service (attempt each day or every other day until the person is home and we get the job done ). Our Flat Fee Rates include 3 attempts so we try and spread that out over 7 days in a routine service to allow for variations in people’s schedules.
In most cases the person being served a document does not have to accept service in order for it to be considered effective. If the recipient comes to the door but refuses the papers being served, the process server may just have to leave them at their feet and then walk away.

There is no limit to the number of times a process server can visit you or come to your house to serve you. Once the papers have not been delivered and you have not acknowledged receipt of the documents that you are served with. The process server can continue to make attempts in order to have you acknowledge or sign them. However, in Ontario and throughout Canada, the Process Server can attempt to serve the document on the respondent three times.

IF THE PROCESS SERVER FAILS TO SERVE THE DOCUMENTS AFTER THREE ATTEMPTS, THE APPLICANT CAN OBTAIN PERMISSION FOR A SUBSTITUTE OR ALTERNATIVE SERVICE FROM THE COURT.

In Small Claims Court, Superior Court, Family and Civil, it is often to your benefit to hire a professional process server to serve your Plaintiff’s Claim or Statement of Claim or Family Law documents. Often, Judges will recognize the process server and will believe the document was served in a proper manner. Should you try and serve the Plaintiff’s Claim yourself, and the Defendant disputes service, you may have a more difficult time proving the service was completed. Respondents/Defendants will react unpredictably when being served a legal document as court can be an intimidating ordeal to learn about.
